This privacy policy (the “Privacy Policy”) governs your use of TeenCentral.com, describes what information we collect through the Service provided by TeenCentral.com. So before using the TeenCentral.com, please read the following.

TeenCentral.com may modify this Privacy Policy from time to time, so please consult it regularly for any such changes. Your use of the Service after any such modifications have been posted shall constitute your acceptance of the revised Privacy Policy.

WHAT INFORMATION WE COLLECT

At TeenCentral.com, we will collect only the information you submit in your story.

HOW WE USE AND STORE YOUR INFORMATION

Your story will be published on the website. This information from your story will not be sold to any third party. We cannot assure you that your information or communications with TeenCentral.com will never be disclosed in a manner inconsistent with this policy, and make no representations or warranties regarding the sufficiency of our security measures to prevent unauthorized access or interception by third parties.

ONLINE COUNSELORS

Our goal is to provide you with therapeutic support. We operate the Service in conjunction with volunteer and staff online counselors (“Online Counselors”). Any information, including Personally Identifiable Information, that you share with the Service may be viewed by Online Counselors. Online Counselors will remove any identifying information and edit your submissions for grammar, spelling, punctuation and obscenities.

THIRD PARTIES; LEGAL PROCESSES

In certain circumstances, we may disclose the information we receive from you to additional third parties if we believe such disclosure is necessary: (A) to comply with the law or in response to a subpoena, court order, government request, or other legal process; (B) to protect the interests, rights, safety, or property of KidsPeace, its affiliates, employees, or agents, including but not limited to Online Counselors; (C) to enforce this Privacy Policy or our terms of service; (D) in connection with a merger, acquisition, liquidation, or corporate divestiture of KidsPeace or its affiliates, or (E) to address fraud, security, technical issues, or to operate the Service or its infrastructure systems properly.

Note that Online Counselors are located across the United States, and may not be licensed in your state or trained in your state’s law. Other state laws may apply to your communications, and those state laws may not protect your communications to the same degree, or in the same way, as the laws of your state.

Governing Law; International Users

The Terms and the provision of the Service is governed solely by, and shall be interpreted according to, the laws of the Commonwealth of Pennsylvania without giving effect to principles of conflict of law. TeenCentral.com and you both consent to the exclusive jurisdiction of the state and federal courts located in Lehigh County or the Eastern District of Pennsylvania. The Service is operated in the United States. If you are located outside the United States, please be aware that any information you provide will be collected in or transferred to the United States. By using the Service or providing us with your information, you consent to that collection and transfer.

Severability; Entire Agreement

If a court finds any provision of these Terms to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and the remaining terms shall remain in full force and effect. These Terms constitute the entire agreement between you and TeenCentral.com, superseding any other written or oral agreements or understandings.

Scope; Acceptance of Terms and Conditions

TeenCentral.com (“Teen Central”, “we”, or “us”), is one way KidsPeace fulfills its mission to give hope, help and healing to children, adults and those who love them. Before using or accessing the service provided by TeenCentral.com (the “Service”), please read the following. By accessing or using the Service you agree to these Terms of Service (the “Terms of Service”) and the privacy policy (the “Privacy Policy” and together with the Terms of Service, these “Terms”) described below. These Terms govern your access and use of the Service. You may contact TeenCentral.com by using the TeenCentral.com feedback form with questions about these Terms. If you don’t agree to these Terms, you may not use the Service.

DESCRIPTION OF THE SERVICE

TeenCentral is an interactive website powered by KidsPeace as a free and safe prevention and intervention resource for adolescents. KidsPeace is a multifaceted national behavioral health provider with 135 years of experience. Through TeenCentral, teens can create a confidential account and find information on a variety of topics, including mental and physical health, relationships and sexuality, substance use and more. Users have the option to submit a story/post regarding any crisis, problem or situation they are struggling with and receive therapeutic support. Teens will receive this support from one of our trained Online Counselors within 24-hours, anonymously, safely and free of charge. Team TeenCentral is a group of trained Online Counselors, comprised of interns and volunteers, as well as two Site Administrators (Master’s Level mental health professionals), and the Director, a Licensed Professional Counselor. Online Counselors for TeenCentral have the responsibility of reviewing a post or story submitted by a user to ensure it is appropriate, and that anonymity is honored. Online Counselors then write a response, comprised of a short summary of the post/story, a series of potential interventions and a several exploratory questions meant to provoke thought. This response encourages the user that they are not alone and that someone is listening. It also empowers them to help themselves through their struggle and offers safe suggestions for help. Once the story and response are posted to the live site, other youth can comment as well, creating a positive environment of peer support. TeenCentral is not an advice column or an online therapy service. Online Counselors do not give personal opinion, tell users what to do or enter into a therapist-client relationship. TeenCentral is a place where teens can find good information on a variety of issues and receive anonymous, unbiased and non-judgmental therapeutic support to help them through difficult times they may experience and empower them to make good choices. The Online Counselors at TeenCentral are trained volunteers and interns and are not medical or mental health professionals. Please note that we take your privacy seriously and your information will never be made public or sold to a third party.

Modification of the Terms of Service

The Terms may be modified from time to time at our discretion. Any changes to the Terms will be effective immediately upon our posting them to TeenCentral.com. Your use of the Service after any such modifications have been posted shall constitute your acceptance of the revised Terms. We encourage you to review our Terms on a regular basis.

Nature and Use of Information Provided through The Service

Please remember that your participation in the Service does not constitute an attorney-client relationship, a doctor-patient relationship, a therapist-client relationship, a therapist-patient relationship or any other sort of confidential relationship. TeenCentral.com is not your doctor, your therapist, your lawyer, your mom, or even your best friend. TeenCentral.com is not a substitute for professional health care. If you believe you are experiencing a medical emergency, immediately call your doctor or 911.

Neither TeenCentral.com, its parent, affiliates, employees, volunteers or agents are responsible for any act or omission to act that you make while, as a result of, or after using the Service. This includes whether you choose to seek or not seek professional care, or to modify or terminate specific treatment that you are currently receiving based on the information provided by this service.

Content Ownership

TeenCentral.com and all of its contents, including but not limited to, directories, photographs, illustrations, images, video and audio clips as well as the trademarks, logos, domain names, trade names, services marks, any and all copyrightable material (including source and object code) and any other form of intellectual property (collectively, the “Material”) are owned by or licensed to KidsPeace Corporation or other authorized third parties and are protected from unauthorized use, copying and dissemination by copyright, trademark, publicity and other law and by international treaties. Nothing contained in this Agreement or on TeenCentral.com should be construed as granting, by implication, estoppels or otherwise, any license or right to use any Material in any manner without the prior written consent of KidsPeace Corporation or such third party that may own the Material or intellectual property displayed on TeenCentral.com. Any unauthorized copying, modification, publication, framing, posting or other unauthorized use of the Material is prohibited. You agree not to use the Material for any unlawful purpose and not to violate KidsPeace Corporation’s rights or the rights of others. TeenCentral.com may add, modify, discontinue, remove or suspend any of the Material at any time, without notice and without liability.

Risks, Use of Service

You assume all risk for use of the Service. Neither TeenCentral.com, its parent, affiliates, employees, volunteers, agents, service providers, or any other entities with whom TeenCentral.com has contracted shall have any liability for (1) actions taken by you or a third party, or not taken by you or a third party, or (2) the unavailability of the service, and you agree to defend, indemnify us and hold us harmless for damages arising out of (A) your use of the Service, (B) your breach of these Terms, (C) your violation of the law, (D) claims asserted by third parties that you are in breach of these Terms or (E) information provided by you through TeenCentral.com. Nothing contained in the foregoing indemnity shall be construed to require indemnification for claims, actions, losses, damages, liabilities or expenses resulting solely from the gross negligence or willful misconduct of TeenCentral.com. In no event shall we be liable for consequential, exemplary, incidental, indirect, or special damages, in connection with your use of the Service.

The Service is provided on an “as is” basis and “as available” basis. TeenCentral.com expressly disclaim all warranties of any kind, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Without limiting the generality of the foregoing, TeenCentral.com makes no warranty that the Service will (A) meet your requirements; (B) be uninterrupted, timely, secure, or error-free; or (C) meet your expectations. The foregoing disclaimers of liability apply to all damages or injury, including those caused by any failure of performance, error, omission, interruption, deletion, defect or delay in operation or transmission, whether for breach of contract, tortious behavior, including negligence, or any other cause of action.

Prohibited Uses; Right to Terminate Access

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for lawful and legitimate purposes. You agree not to use the Service:

  • in any way that violates any applicable federal, state, local and international law or regulation;
  • for the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personal information or otherwise;
  • to threaten, harass, or otherwise inappropriately abuse TeenCentral.com, its employees, partners, agents, volunteers, subcontractors, or others;
  • to send, knowingly receive, upload, download, use or re-use any content which does not comply with these Terms;
  • to “spam,” gather or attempt to gather personal information belonging to users or others for the purposes of spamming, marketing, selling to third parties, or otherwise abusing TeenCentral.com or its users;
  • to impersonate or attempt to impersonate another person or entity; or
  • to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm users of the Services or expose them to liability; or
  • to copy, adapt, decompile, reverse engineer, attempt to discover the source code of or make a derivative works of the Service or any portion of the Service; or
  • to otherwise attempt to interfere with the proper working of TeenCentral.com

TeenCentral.com reserves the right to terminate your access to the Service if you violate these Terms, including by engaging in the prohibited uses described above. TeenCentral may, in its discretion, unilaterally terminate your access to the Service. TeenCentral.com reserves the right to terminate the Service or your access to it, for any reason, at our sole discretion.

We take your privacy and security very seriously, so we employ reasonable security controls (including encryption) to help protect your information. We cannot guarantee protection from intruders, hackers or interceptors. You agree to use the Service and submit information to TeenCentral.com at your own risk, and you agree that TeenCentral.com has no liability regarding anyone’s unauthorized access to TeenCentral.com or the data associated with it.
